Gauteng MEC for Housing Nomvula Mokonyane has strongly called on all
families whose houses have not yet been transferred, with potential ownership
disputes, to approach their local municipalities to claim and register for
Family Title Mediation.
This process will ensure that all family members with legal rights are
included on the title deeds as co-owners of their parental or family houses in
order to minimise legal disputes. The MEC also encouraged parents to draft last
wills or testaments in order to make it easier for the remaining family members
once they have departed.
âThe fact that we have completed over 11 119 family disputes related to
title deeds from mainly black townships such as Soweto should drive all of us
to seek solutions as most disputes arise mainly because of the unavailability
of last wills and testaments.â
âThis development also raises concerns over a number of challenges still
facing our communities over the understanding and interpretations of our laws
of succession.â
MEC Mokonyane also urged all Gauteng residents who have not yet made claims
for their houses to be transferred to come forward urgently. About 15 386
claims have already been received to date and more are expected during the
year. Approximately 20 000 houses have not been claimed in Gauteng.
She said the department anticipates that all outstanding cases and claims in
the departmentâs possession would be finalised by 31 December 2009.
