The Minister of Home Affairs Nosiviwe Mapisa-Nqakula welcomes today's
judgement by the Constitutional Court against Khalid Rashid.
The Minister believes that the judgement strengthens the rule of law and the
concept of equity and fairness before the courts for all. The Court has found
that Mr Rashid must follow standard legal procedures in attempting to appeal
the Pretoria High Court ruling upholding his deportation and may not take short
cuts.
"Today's judgement comes against the backdrop of the finding in February by
the Pretoria High Court that the Department of Home Affairs had in the case of
Mr Rashid applied the law without fear or favour and had acted lawfully in
deporting Mr Rashid," commented the Minister.
She added: "Home Affairs will continue to administer the Immigration Act and
all other laws within its authority in the interests of the people of South
Africa."
