Independent Communications Authority of South Africa pursuant
to the Electronic Communications Act, 2005

The Independent Communications Authority of South Africa (Icasa) pursuant to
the Electronic Communications Act, 2005 hereby issues notice of intention to
prescribe procedures and criteria for awarding radio frequency spectrum
licences for spectrum available to accommodate demand in terms of section 31
(3) of the Electronic Communications Act, No. 36 of 2005.

1. Icasa ("the authority") hereby issues a notice and advises interested
members of the public of its intention to embark upon a process that will
result in the publication of the procedures and criteria for the awarding of
radio frequency spectrum licences for competing applications or instances where
there is insufficient spectrum available to accommodate the demand thereof.

2. The authority is presently going through internal processes of finalising
the requisite research prior to the publication of a discussion document that
will be disseminated for comment and analysis by interested members of the
public.

3. The authority further wishes to put it on record that in the past it has
dealt with spectrum licence applications on an ad-hoc basis and it is the
intention of the authority to depart from such a practice and embark upon a
more coherent and consistent framework which would allow interested parties to
compete fairly and equally for the available spectrum.

4. The authority intends, upon completion of the internal processes and the
necessary research, to publish by way of notice in the government gazette a
discussion document that will invite interested parties to submit written
representations to the authority within such period as may be specified in such
a notice for analysis and possible incorporation of such representations into
the final draft of the procedures and criteria for the awarding of radio
frequency spectrum licences.

5. The authority shall, if the need arises, hold an oral hearing in respect
of the proposed draft procedures and criteria whereat interested parties may be
given an opportunity to address the authority on its representations.
