Department of Labour’s Compensation Fund appreciates media expose of unfair labour practices

The Department of Labour has taken keen interest on two cases exposed by eNCA involving workers who got injured at work and their employers who failed to assist them to lodge claims with the Compensation Fund.

According to the Compensation for Occupational Injuries and Diseases Act employers are required to report the occupational injury to the Compensation Fund within 12 days of the incident.

“In the case of the two injured workers featured on eNCA, both employers had not registered the claims as required in terms of Section 39 of the Compensation for Occupational Injuries and Diseases Act. Concurrent with the enforcement processes by Inspection and Enforcement Services, the Fund will be initiating the claims to assist the two workers,” said Mr Vuyo Mafata, Compensation Fund Commissioner.

The Minister of Employment and Labour, Mr Thulas Nxesi was appalled by the reported incidents and has called upon workers who experienced similar treatment by their employers to report such cases at their nearest Labour Centres. The Minister has directed the Department to initiate an investigation on the two companies and if found guilty issue a Section 32 enquiry to investigate the cause of the accidents.

The Compensation Fund has issued a last opportunity notice to invite all persons who have a claim that was not finalised to submit such information to the Fund by the 31st August 2019. All interested parties to such claims are advised to make use of this opportunity to get their claims adjudicated and be able access compensation for injury on duty.
