Update on progress made in the review applications in the hake inshore trawl sector

On 30 January 2018, Minister Senzeni Zokwana (MP) issued a press release indicating his intensions to keep members of the public and fishing industry at large abreast of progress made in resolving judicial reviews in the Hake Inshore Trawl sector.

This press release outlines the progress of the Minister of Agriculture, Forestry and Fisheries (the Minister) in considering the  Hake Inshore Trawl (HIT) appeals in light of the on-going judicial review processes across Categories A, B and C.

There are presently no Category A appeals before the Minister. However one of the appellants in Category A has made its intention known to review the Minister’s decision of 10 July 2017. The Minister is taking legal advice thereon.

In respect of Category B, it is common cause that appellants have brought applications for the Minister’s Section 80 decisions to be reviewed and set aside. The parties are in the process of negotiations that are expected to be concluded within a week. The Minister will thereafter be in a position to consider the relevant Category B appeals.

The Western Cape High Court ruled that the Minister should reconsider his decisions in respect of Category C.  However, the 7th respondent in case number: 13778/2017 has launched an application for leave to appeal in this regard. The appeal will tentatively be heard in the week beginning 5 March 2018, and the Minister will be able to communicate regarding developments in this category thereafter.

Thus the Minister, at this present moment, cannot deal with HIT appeals until such time as all pending judicial reviews and other legal implications have been resolved.

The Minister will in the meantime consider and evaluate appeals relating to the Large Pelagic Longline sector. The Minister foresees finalising his decision on appeals filed in the Large Pelagic Longline sectors by the end of February 2018.
