Date set for NPA’s application for leave to appeal Oscar Pistorius judgement and sentence
The NPA announces that the application for leave to appeal both the conviction and sentence in the aforesaid matter will be heard at the North Gauteng High Court on 9 December 2014. The NPA also confirms receipt of a notice from the defence that they will oppose the application by the state.
The decision to appeal was taken on the basis that the NPA believes there exists reasonable prospects of a successful appeal based on a question of law.
The NPA reiterates its view on the critical importance to seek clarity from Supreme Court of Appeal on the principle of Dolus Eventualis.
