Dr Adams found guilty of defrauding Department of Labour’s Compensation Fund

Dr David Michael Adams (41) was today found guilty by the Pretoria Magistrates’ Court of defrauding the Department of Labour entity, the Compensation Fund (CF) of R396 660-00.

Dr Adams was found guilty of contravention of section six of prevention of organised crime act, and also guilty of theft.

The fraud doctor was facing 29 counts of contravening Section 6 of the Prevention of Organised Crime Act, and 29 counts of theft. Dr Adams pleaded not guilty in the Pretoria Magistrates’ Court in September 2016.

The defence in the matter closed its case without leading evidence, alleging that the State based its case on suspicion.

Delivering sentencing Magistrate Ms Ncube said the State found witnesses reliable in their testimony.

Dr Adams is said to have received unlawful payments from the Compensation Fund, and was arrested in 2010. During his arrest Dr Adams was running his practice in the North West. Despite being offered an opportunity to repay back the money, before his arrest Dr Adams failed to accept the offer and opted to use the money for personal use.

Dr Adams is out on a warning and his sentencing proceedings will begin on May 11.

The Asset Forfeiture Unit has in terms of Section 18 applied for order to ascertain the extent of Dr Adams benefits of ill-gotten gains.

The Compensation Fund is a public entity under the administration of Department of Labour. The CF provides cover to workers injured and/or who contract diseases at work.
