Parliament discusses recommendations by President on Petroleum Resources Development Amendment Bill

The Portfolio Committee on Mineral Resources discussed recommendations by the President on Petroleum Resources Development Amendment (MPRDA) Bill. The President referred the Bill back to Parliament with four recommendations including a referral of the Bill to the National House of Traditional Leaders and allocation of sufficient time for the National Council of Provinces to provide inputs, amendment to section 26 (2b) and 26 (3) of the Bill and definition of “this Act” and amendment of section 74 of the Act.  

Committee Chairperson, Ms Sahlulele Luzipho, reiterated that the Committee would be restricted by recommendations raised by the President and it would not make further input into the Bill. The Committee also received a legal opinion from Parliamentary Legal Services team that reaffirmed the fact that the Bill was returned on the ground of constitutionality and procedure. The Committee will meet next week (25 Wednesday 2015) to discuss a process that will be followed to respond to the constitutional reservations raised by the President.
