About applying to register a sterilising plant

To operate a sterilising plant, you must register it in terms of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act 36 of 1947). A sterilising plant is used for sterilising animal products from any vertebrate or invertebrate specified by the Minister.

To qualify:

  • the sterilising plant must be based in South Africa
  • you must get inspection reports from the  state veterinary official and an environmental health officers in your province
  • the plant must:
    • comply with hygiene requirements
    • comply with the requirements of the sterilising plant regulation
    • have good storage facilities
    • process animal products that are free from pathogenic organisms.

Once the Registrar of Act 36 of 1947 has received your application form and the inspection reports, an inspector from Act 36 of 1947 will inspect sterilising plant to assess whether it complies with the requirements of the Act and its  regulations.

If the Registrar is satisfied with the inspection, the plant will be registered and the certificate issued. The Sterilising Plant Certificate is valid for three years. You must apply for renewal by 31 March in the year that the registration expires.

Note: The Registrar of Act 36 of 1947 will cancel your registration any time if:

  • you have contravened or failed to comply with a provision of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act 36 of 1947)
  • you have failed to comply with the registration conditions
  • your plant does not comply with the prescribed conditions or is no longer effectively equipped for sterilising
  • your plant is contrary to public interest.

What you should do

  1. Contact your provincial department of agriculture and ask for a state veterinary official and an environmental health officer in your area.
  2. Ask the state veterinary official and the environmental health officer to inspect the sterilising plant so you can get veterinary inspection and environmental health reports.
  3. After you have received the reports, download the application form for registration of sterilising plant and fill it in. Alternatively, you can get the form from the Registrar’s Office at Agriculture Place, 20 Steve Biko Street, Arcadia, Pretoria.
  4. Pay the prescribed fee by cheque or electronic fund transfer (EFT) to the Director-General: Department of Agriculture, Forestry and Fisheries.  If you intend to pay your fee by EFT, you must pay it into the following account:
    Account name: NDA-ACT 36 of 1947
    Account Number: 11 2031 02
    Reference: 13SP1 and the name of the plant
    Branch code: 01 0845
    Bank name: Standard Bank.
    Reference: 13SP1 and the name of the plant. If you hand-deliver your application fees, make sure you get a receipt of payment.
  5. You must attach the following to your application form:
    • proof of payment 
    • veterinary and environmental health inspection reports
    • facilities plan and manufacturing process(es)
  6. Send your application documents by post to: The Registrar Act 36 of 1947, Private Bag X343, Pretoria 0001 or hand deliver it to: The Registrar Act 36 of 1947, Agricultural Place, 20 Steve Biko Street, Pretoria
