Act

• to amend the Water Research Act, 1971, so as
  • to authorize the Minister of Environment Affairs to write off from time to time certain irrecoverable rates, charges and interest; and
  • to provide for the delegation of powers by the said Minister; and
• to provide for matters incidental thereto.

BE IT ENACTED by the State President and the House of Assembly of the Republic of South Africa, as follows:-

Amendment of section 11 of Act 34 of 1971, as amended by section 1 of Act 106 of 1977.

1. Section 11 of the Water Research Act, 1971, is hereby amended by the insertion after subsection (5) of the following subsection:

"(5A) The Minister may from time to time write off any rates or c arges which must be recovere in terms of subsection (2) or any interest charged thereon under subsection (5), if such rates, charges or interest for any reason cannot be recovered.".

Insertion of section 14A in Act 34 of 1971.

2. The following section is hereby inserted in the Water Research Act, 1971, after section 14:

"Delegation of powers by Minister.

14A. (1) The Minister may delegate any power conferred upon him by section 11 (5A) or 13 (6) to the Director-General: Environment Affairs or any other officer in the Department of Environment Affairs.

(2) The Minister may at any time revoke any delegation under subsection (1), and no delegation of any power shall prevent the exercise of that power by the Minister himself.".

Short title.

3. This Act shall be called the Water Research Amendment Act, 1982.
