Act

  • to amend the Road Accident Fund Commission Act, 1998, so as:
    • to further provide for the duties of the Commission with regard to its inquiry in terms of section 5(1);
    • to extend the period within which its report has to be submitted to the President; and
    • to provide for the extension of that period by the President; and
  • to provide for matters incidental thereto.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:—

Amendment of section 7 of Act 71 of 1998

1. Section 7 of the Road Accident Fund Commission Act, 1998 (Act No. 71 of 1998), is hereby amended—

(a) by the substitution for subsection (1) of the following subsection:

“(1) The Commission must [complete], after completion of the inquiry referred to in section 5(1) [within a period of nine months from the date of appointment of the members of the Commission in terms of section 3(1)], prepare a written report containing its findings and conclusions, and the recommendations referred to in section 5(2).’”;

(b) by the deletion of subsection (2); and

(c) by the substitution for subsection (4) of the following subsection:

“(4) (a) The Commission must submit its report to the President within a period of [three] 24 months from the [completion of the enquiry] date of appointment of the members of the Commission.

(b) The President may, by proclamation in the Gazette, extend the period referred to in paragraph (a) if the Commission requests the extension of the period in writing. ”.

Short title

2. This Act is called the Road Accident Fund Commission Amendment Act, 2000, and must be regarded as having taken effect on 1 June 1999.
