58 of 2002

The Patents Amendment Act 58 of 2002 intends:

  • to amend the Patents Act, 1978, so as:
    • to bring certain provisions in line with the Agreement on Trade-related Aspects of Intellectual Property Rights;
    • to bring provisions regarding the processing and amendment of applications under the Patent Co-operation Treaty in line with other applications;
    • to effect technical corrections to some provisions and clarify others;
    • to provide for the non-infringement of a patent under certain circumstances; and
  • to provide for matters incidental thereto.
