39 of 2000

The Competition Second Amendment Act 39 of 2000 intends:

  • to amend the Competition Act, 1998, so as:
    • to define certain expressions, to amend certain definitions and to delete a definition;
    • to further regulate the prohibition of restrictive horizontal practices;
    • to allow for more frequent determination of the thresholds for the application of the said Act;
    • to further regulate certain exemptions;
    • to make fresh provision for merger control;
    • to further regulate the functions of the Competition Tribunal;
    • to provide expressly that the Commissioner is the accounting authority of the Competition Commission for purposes of the Public Finance Management Act, 1999;
    • to further regulate investigation and adjudication procedures and enforcement of decisions, judgments and orders of the Competition Commission, Competition Tribunal and Competition Appeal Court;
    • to regulate the relationship between the Competition Commission and other agencies and to provide for concurrent juridiction; and
    • to effect certain consequential amendments; and
  • to provide for matters connected therewith.
